Why a Divorce? 为什么离婚?

In the above verse, it is clearly indicated that the first step is to try to solve the problem between husband and wife in a friendly manner, so as to keep the marriage institution intact, and the husband and wife are not separated.在上面的诗句,它是明确表示,第一步是设法以友好的方式解决与丈夫和妻子的问题,以保持完整的婚姻制度,和丈夫和妻子没有分开。

'Iddah As a Means of Reconciliation 'Iddah作为和解手段
The regulation on iddah comes from the following verse :关于iddah监管来自下面的诗句:

'Iddah is the 3 cycles of monthly periods (or three months for women without menses) enforced on the wife after the divorce. Are Women Abandoned or Oppressed Upon A Divorce? 是妇女被压迫被遗弃或离婚后阿?
Often, a woman is the victim as a consequence of divorce.通常,一个女人,作为离婚后果的受害者。 The Holy Qur'?however provides regulation that should be followed by the couple following a divorce, in order to protect the women from being oppressed.神圣的古兰经'?但监管规定,应遵循以下的夫妇离婚,以保护妇女免受压迫。

The above verse outlines the regulations set by God binding the husband:上述诗句概括了条例规定由上帝约束力的丈夫:

This regulation protects a wife from being abused by her husband upon divorce.本法规保护不受离婚后,她的丈夫虐待妻子。 Apart from that, Islam guarantees the right of the wife with regard to her maintenance.此外,伊斯兰教就向她保证维护妻子的权利。

According to the sharia' regulation, a woman in 'iddah is still considered as the responsibility of the husband, and therefore still has the right to get the provision for her maintenance throughout the period.根据伊斯兰教法'监管,'女子iddah仍然认为是丈夫的责任,因此仍然有权利让她在整个维修期间的规定的。 This is the period whereby the wife will be able to prepare herself for her future life.这期间,让妻子将能够为她准备自己未来的生活。

A husband is also required to give a settlement or gift (mut'ah) to his wife upon divorce for her future use, as shown in Sura' Al-Baqarah 241:丈夫也需要给予解决或礼物(mut'ah)离婚后,他的妻子为她日后的使用,在苏拉'古兰经241所示:

However, both father and mother still have the right over their children, and this right is protected in Sura' Al-Baqarah verse 233:不过,父亲和母亲都仍然有对子女的权利,这种权利是在苏拉'古兰经经文233保护:

As can be seen from the above facts, the rights of both husband and wife are protected in Islam, in a manner in which the divorce can be done peacefully, without resulting any unnecessary pain to any party.由于可以从上述事实看出,丈夫和妻子的权利受到保护伊斯兰教,而在这方面可以做的离婚和平的方式,没有造成任何不必要的痛苦,任何一方。
Can A Wife Divorce her Husband? 可以一个妻子离婚的丈夫?

This right is also given to a wife to get a divorce through the power of judges, or qadhi to separate the wife from her husband.这项权利也赋予妻子度过了法官的权力,或qadhi离婚分开丈夫的妻子。 A wife is given right to request for fasakh if any of the following (to mention a few) problems occur in the marriage:妻子是赋予的权利要求为fasakh如果下列任何(仅举几例)在婚姻中出现的问题:

The Holy Qur'?outlined the problem in the following verse:神圣的古兰经'?所述的问题在下面的诗句:

d) The condition of husband, such as being impotent or having a mental problem in which is not known to the wife prior to the marriage, if such a problem can affect the condition of the marriage. d)在丈夫的条件,如被无能或有精神问题,这是不知道的妻子结婚之前,如果有这样的问题会影响婚姻的条件。
2) Khulu' 2)Khulu'
Khulu' is a settlement made by a wife to the husband in order to get a divorce. Khulu'是一个离婚协议所定的妻子的丈夫为了获得。 This provision is allowed in the following verse:这一规定是允许在下面的诗句:

Khulu' is the provision for the woman to get a divorce, but is not able to do it by way of fasakh.
